Our franchising team provides expert legal advice in relation to all areas of franchise law. We are also a professional affiliate of the British Franchise Association.
For new franchisors we provide a full legal service including the preparation of all documents necessary to establish a new franchise, including master licence agreements, franchise agreements, software licence agreements and also operations manuals.
For prospective franchisees, we offer a fixed price service for advising on draft franchise agreements.
In addition, we advise both franchisors and franchisees on day-to-day contentious and non-contentious issues such as commercial property, employment, intellectual property and litigation.
Examples of recent experience:
- Advising on the legal issues surrounding the franchising of an “after school” club including the sale of a number of existing franchised outlets.
- Assisting generally in the franchising of a driving school.
- Advising a franchisee association of a well known franchise in respect of fundamental breach by the franchisor including on “derogation from grant” issues.
- Defending a franchisee against allegations of defamation and passing off by the franchisor.
