The client instructed Darwin Gray’s Insolvency Team, through Begbies Traynor LLP, to act in an annulment application, in which bankruptcy had occurred to the Trustee in Bankruptcy. In this case, there were more than sufficient funds in the estate to settle all debts and expenses in full.
This case had many challenge aspects that made case more demanding and extensive. For instance, by the time of the hearing, two of the known creditors had still not submitted their proofs of debt.
Kate from the Darwin Gray Insolvency team managed to obtain a conditional annulment order which allowed those creditors an additional 21 days to submit their proofs of debt.
Upon the client submitting their report to court to confirm that all proved creditors have been paid in full following their 21-day extension, the bankruptcy was successfully annulled.
