Employment law and HR for Charities, Public and Third Sector

Looking for the best solicitors to advise your organisation or charity on employment law and HR?

We understand that third sector organisations and charities face a very unique set of challenges when dealing with staff and HR problems. You will often face issues that are relevant only to your sector, with financial and funding considerations also playing their part. Our Employment and HR team is widely respected in the area of employment law for charities and other third sector organisations.

What type of organisations can we help?

We act for many organisations in the third and public sector, as well as charities, right across Wales. We often advise these clients through the medium of English, Welsh or bilingually and regularly hold training sessions aimed specifically at these sectors.

What type of services do we provide?

The support we can provide includes preparing employment contracts, advising on the employment status of freelancers, advising you on or conducting your disciplinary and grievance processes on your behalf, through to advising on employment tribunal claims.

Governance and HR training and health checks

As well as advising on employment law matters, we also advise charities and third sector organisations on their governance matters. This includes preparing or reviewing constitutions, articles, and codes of conduct for trustees or board members, as well as advising in board disputes.

We can also offer a “health check” of all of your governance and HR documents (including your employment contract and policies) to help you ensure that your organisation is compliant with its legal and governance obligations and help you to develop and maintain a healthy working relationship with your staff.

“Darwin Gray offer us truly superb HR services. We are a network of 3rd sector organisations across Wales and what DG has offered us over the last 3 years has been invaluable. Very professional, quick and services available bilingually which is very important to us, highly recommend.”

Iwan Hywel, Mentrau Iaith Cymru

Specialist advice for the charity sector

We know that many charities (particularly small and medium charitable employers) are struggling with meeting compliance obligations in the area of employment law, such as paying the national minimum wage, complying with obligations to voluntary workers or self employed freelancers, and acting swiftly and appropriately during workplace disputes. Employment disputes can have a huge impact on many charities and their ability to provide their services for the public benefit.

A charity’s property must be carefully safeguarded and applied in accordance with its charitable purposes and Charity Commission requirements, and trustees and senior management may be reluctant to risk spending the charity’s funds on legal fees. Our employment and HR team understands the constraints arising out of charity employment disputes and will advise you on how we can help with your governance, HR or employment issues proportionately, reasonably and in a cost-effective way – whether that is advising urgently on managing risks arising out of a serious incident at work, guiding you on how you can manage disciplinary or performance issues or employee relations issues, helping you to defend an Employment Tribunal claim, or making sure you have a suitable template employment contract and appropriate policies in place.
