Annulling a Bankruptcy Order

To annul a bankruptcy means to essentially ‘undo’ the bankruptcy, as if it had not been ordered in the first place. Upon a successful application, the bankruptcy order is to be treated as if it had never been made and, as far as is practically possible, the individual is put back into their original position (had the order not been made).

Can I annul my bankruptcy?

Annulment of an individual’s bankruptcy is not open to all bankrupt individuals. Our Insolvency Team specialises in assisting individuals to annul bankruptcy orders in the following circumstances:

• where it can be shown that making a bankruptcy order in the first place was unjustified;
• all the debts of the bankrupt individual have been paid in full (or secured to the satisfaction of the court); or
• an IVA has been put in place.
